WHEREAS the Price County Board of Supervisors at their November 17, 2008 meeting, after public hearing, adopted the 2009 budget for Price County, and WHEREAS the Executive/Finance / Information Technology Committee of the Price County Board of Supervisors on January 16, 2009 were advised of changes to the revenues which have been made available to the Health department, and WHEREAS the Wisconsin Statutes 65.90(5)(a)(1) states “A budget…may not be changed unless authorized by a vote of two-thirds of the membership of the governing body of the municipality”, and WHEREAS the proposed amendments recommended by the Price County Executive/Finance / Information Technology Committee does not change the amount of tax levied and the proposed amendments will more accurately record the financial activities of Price County during 2009, BE IT RESOLVED by the Price County Board of Supervisors at their February 17, 2009 meeting that the 2009 budget as adopted be amended to include the following changes:

Amend the Price County Zoning Ordinance 4-79, Section 2.2
WHEREAS, Chapter 59, Wisconsin Statutes require that the Zoning Committee hold a public hearing and report to the Price County Board of Supervisors on all petitions to amend Zoning Ordinances or Zoning District Maps; and WHEREAS, the Price County Board of Supervisors must then act upon the recommendation of the Zoning Committee, either approving or disapproving or returning the petition with changes recommended by the Price County Board of Supervisors, and WHEREAS, the Zoning Committee has held a public hearing and hereby recommends that the Price County Board of Supervisors ratify the amendment attached; NOW THEREFORE BE IT RESOLVED, that the Price County Board of Supervisors approve the amendment to the Price County Zoning Ordinance 4-79, Section 2.2, regarding multi-family dwellings and/or legally permitted resorts on lots less than the required minimum square footage. The unincorporated areas of Price County are hereafter regulated as to the use of any land or water; the size, shape, and placement of lots; the use, size, height, type, and location of structures thereon; and the provisions for open space shall be in compliance with the regulations set forth on the Official Zoning Map, Price County, Wisconsin and in the text of this Ordinance.
2.2 SITE REQUIREMENTS
Every building hereafter erected or relocated shall be on a lot or parcel created in accordance with the provisions of the Price County Subdivision Control Ordinance or on lots or parcels already created and recorded prior to April 11, 1968; where the Sanitary Code and other applicable requirements can be met.
Only one principal building or dwelling unit permitted per minimum lot size (as specified in the Price County Subdivision Control Ordinance). Minimum lot size will be required for each additional principal building or dwelling unit erected except for legally permitted multi-family dwellings or legally permitted resorts where the minimum lot size shall not be required for each dwelling unit.

Amend the Sanitary Permit Fee
WHEREAS, The Price County Zoning Department issues sanitary permits for the construction of private onsite wastewater systems; and WHEREAS, administrative code Comm. 2.67 requires the Zoning Department to forward to the Department of Commerce a portion of each sanitary permit fee; and WHEREAS, the portion of the fee to be forwarded to the Department of Commerce has recently increased from $75 to $100; and WHEREAS, the Price County Board of Supervisors is responsible to establish all Zoning Fees; NOW THEREFORE BE IT RESOLVED, that the Price County Board of Supervisors increase the sanitary permit fee for all private onsite wastewater systems $25 to compensate for the increase to the fee to be forwarded to the Department of Commerce as per Comm. 2.67. 5.02 SEPTIC TANK MAINTENANCE PROGRAM.
(1) All septic tanks permitted and
installed on or after January 1, 1986 shall be visually inspected and/or
pumped, in accordance with Comm. 83.255
section 7, within three years of the date of installation and at least once
every three years thereafter, unless upon inspection the tank is found to have
less than 1/3 of the volume occupied by sludge and scum.

Amend the Price County Private Floodplain Ordinance (Section 1.5)
WHEREAS, Chapter 59, Wisconsin Statutes require that the Zoning Committee hold a public hearing and report to the Price County Board of Supervisors on all petitions to amend Zoning Ordinances or Zoning District Maps; and
WHEREAS, the Price County Board of Supervisors must then act upon the recommendation of the Zoning Committee, either approving or disapproving or returning the petition with changes recommended by the Price County Board of Supervisors, and WHEREAS, the Zoning Committee has held a public hearing and hereby recommends that the Price County Board of Supervisors ratify the amendment attached; NOW THEREFORE BE IT RESOLVED, that the Price County Board of Supervisors approve the amendment to the Price County Floodplain Ordinance pertaining to Section 1.5, addition of the dam break analysis for the Pixley and Crowley Dams on the Flambeau River. 10.8 WIND ENERGY SYSTEMS
A. A micro wind energy system shall be defined as having a maximum nameplate capacity of 10 kilowatts and a total height less than 80 feet.
B. A small wind energy system shall be defined as having a maximum nameplate capacity of 100 kilowatts and a total height less than 170 feet.
C. A large wind energy system shall be defined as having a nameplate capacity of more than 100 kilowatts and/or a total height more than 170 feet.
D. More than one micro or small wind energy system on a parcel shall be considered a large wind energy system.
E. Total height means the vertical distance from the surface of the in-situ soil on which the base of the support structure sits to the tip of a wind generator blade when the tip is at its highest point.
F. A wind energy system less than 80 feet in total height shall meet all setback requirements as for an accessory structure in the respective district. The setback shall be measured from the base of the tower.
G. A wind energy system with a total height greater than 80 feet shall be located on a parcel so as the base of the support structure is located a distance equal to the total height of the wind energy system away from any adjacent property owned by others. Such setback shall be adhered to regardless of whether the adjacent parcel is privately or publicly owned.
H. All wind energy systems shall comply with the provisions established by the Price County Ordinance Regulating the Height of Structures and Trees in the Vicinity of the Price County Airport.
I. The use of any wind energy system shall comply with all applicable state and federal regulations.

Amend Ordinance No. 4-79 (Krings Rezone)
WHEREAS, Chapter 59, Wisconsin Statutes require that the Zoning Committee hold a public hearing and report to the Price County Board of Supervisors on all petitions to amend Zoning Ordinances or Zoning District Maps; and
WHEREAS, the Price County Board of Supervisors must then act upon the recommendation of the Zoning Committee, either approving or disapproving or returning the petition with changes recommended by the Price County Board of Supervisors, and WHEREAS, the Zoning Committee has held a public hearing and hereby recommends that the Price County Board of Supervisors approve the rezoning of the following described parcel:
One parcel of land, Lot 7 of the Crowley Shores Subdivision, Section 14, Township 39 North, Range 2 West, Town of Lake. This is being changed from Agricultural (A-1) to Recreational Residential District (RR-1).
NOW THEREFORE BE IT RESOLVED, that the Price County Board of Supervisors approve the rezoning petition for Steven Krings. County Snowmobile Trail Aids
WHEREAS, Price County is interested in maintaining, acquiring and insuring snowmobile trail use; and WHEREAS, said public snowmobile trails are eligible for funds under ss. 23.09 (11) and (26) and 350.12 (4), Stats.; NOW, THEREFORE, BE IT RESOLVED that Price County annually apply for funds under ss. 23.09 (11) and (26) and 350.12 (4), Stats., for such eligible maintenance, development, acquisition, and insurance costs, and effective July 1, 2009, hereby authorize Evan Lund, Land Conservationist and Snowmobile Coordinator to act on behalf of Price County to: Submit an application to the State of Wisconsin, Department of Natural Resources for any financial aid that may be available; sign documents; and take necessary action to undertake, direct and complete the approved project. WHEREAS, Price County has formed, by resolution, a public County Forest as authorized under State Statutes Section 28.10; and WHEREAS, the SE ¼ SW ¼, Section 18, Township 37 North, Range 3 East (approximately 40 acres) is owned by Jonathan Gossfeld; and WHEREAS, a land exchange offer has been made by Jonathan Gossfeld for the above described land for the SE ¼ NW ¼, Section 19, Township 37 North, Range 3 East (approximately 40 acres) owned by Price County; and WHEREAS, County ownership of the SE ¼ SW ¼, Section 18, Township 37 North, Range 3 East will reduce the need to maintain one and one-half miles of property line, provide better public access, resulting in more public use and insure long term protection of the resource; and WHEREAS, in order to make this exchange, SE ¼ NW ¼, Section 19, Township 37 North, Range 3 East must be withdrawn from the County Forest Law ss 28.11(11); and NOW, THEREFORE, BE IT RESOLVED that Price County make application to the Department of Natural Resources to withdraw the SE ¼ NW ¼, Section 19, Township 37 North, Range 3 East from the County Forest Law as per State Statute 28.11 (11) (a); and BE IT FURTHER RESOLVED, that if the above application for withdrawal is approved, that Price County exchange said acreage with Jonathan Gossfeld; and BE IT FURTHER RESOLVED, that upon completion of said exchange that the Tourism/Forestry and Parks Committee make application to enter the acreage received by Price County under the County Forest Law ss 28.11 (4) (a). Approve Amendments to the Price County Personnel Policies and Procedures Manual Policy #375
WHEREAS, The Personnel Committee has been charged by the Price County Board of Supervisors with the responsibility of developing, maintaining and enforcing policies and guidelines for employees and has also been charged with the responsibility of periodically reviewing said policies and procedures and, WHEREAS, the Personnel Committee had undertaken a thorough review of all personnel policies and procedures, including the 1991 Personnel Policies and Procedures handbook, all subsequent policies added by County Board Resolution and current practices and procedures and, WHEREAS, the Personnel Committee has compiled an updated manual which incorporates these policies along with established practices and procedures and updated employment laws and said manual was approved by Price County Board on February 2l, 2006 and, WHEREAS, since its adoption, changes need to be made to Policy #375.0 to clarify the process for how mileage traveled for County business is reimbursed, and WHEREAS, the Personnel Committee has approved the changed drafts of Policy #375.0 and has forwarded said changes to Full County Board for approval, NOW THEREFORE BE IT RESOLVED, by the Price County Board of Supervisors assembled this 17th day of February, 2009, that the above listed changes are approved and are to be incorporated into Price County Personnel Policy and Procedures Manual. WHEREAS, The Personnel Committee has been charged by the Price County Board of Supervisors with the responsibility of developing, maintaining and enforcing policies and guidelines for employees and has also been charged with the responsibility of periodically reviewing said policies and procedures and, WHEREAS, the Personnel Committee had undertaken a thorough review of all personnel policies and procedures, including the 1991Personnel Policies and Procedures handbook, all subsequent policies added by County Board Resolution and current practices and procedures and, WHEREAS, Policy #370 and 370.5 governs the use of County vehicles and limits the use of said vehicles to County employees only, and WHEREAS, the Human Services Department has made a request to allow individuals who are not employees of the County but who are engaged in authorized County business to use County owned vehicles to promote more efficient and cost effective methods of doing County business, and WHEREAS, the Executive/Finance Committee reviewed the request and determined there would not be any liability issues created by allowing authorized non employees to use County vehicles and forwarded the request to the Personnel Committee, and WHEREAS, the Personnel Committee has reviewed the request and approved the changes to Policies #370 and 370.5 and have forwarded said changes to Full County Board for approval, NOW THEREFORE BE IT RESOLVED, by the Price County Board of Supervisors assembled this 17th day of February, 2009, that the above listed changes are to be incorporated into Price Count Personnel Policy and Procedure Manual.

Whereas the Price County Personnel Committee has reached an agreement between Price County and Price County Professionals Union Employees, Local #116, LAW and, Whereas the Price County Personnel Committee recommends ratification of this agreement, Now Therefore Be It Resolved by the Price County Board of Supervisors, duly assembled this 17th day of February, 2009, that the collective Bargaining Agreement covering the period of time from January 1,2008 through December 31, 2009, a copy of which is attached hereto, is hereby ratified and approved.
