Approval of meeting minutes of the April 20, 2010 meetings:  Motion Robb/Laws to approve minutes of the April 20, 2010 meetings as amended to remove Robert Rogalla’s vote from the election for Chair (Mr. Rogalla was excused from the meeting).  Motion carried.

Communications and Announcements:  Janssen – Wisconsin Nutrition Education Program (Wendy Rebne and Connie Grapa) offering snacks in the hall.  Czech Fest soliciting Kolache contest judges.  Smoke Free Law being implemented July 5th.

Public Comment:  Janssen – Questioning potential conflict of interest with Highway Committee Chair and relative (wife’s nephew) working for the department.  Discussed his own issue with charges of conflict of interest for contracting bidding with the County.  Ginny Strobl, Town of Georgetown – requested more detail be available on agenda items.

Resolution 25-10

Designation of the Pine Line Recreation Trail as a County Park

WHEREAS, the Pine Line Recreation Trail has been owned by Price and Taylor Counties and operated by the Price/Taylor Rail Trail Commission since 1989; and WHEREAS, the Commission has made significant progress toward a fully developed recreational trail by means of grants, fund raisers and donations; and WHEREAS, the Pine Line Trail has had and will continue to have a very positive impact on Price County’s Tourism industry; and WHEREAS, the County park designation will assist the Commission in it’s goal of developing and maintaining a first class recreation trail by: 1. Expanding the number and type of grants available for trail development. 2. Provide an opportunity for requesting county funds through the annual budget process. THEREFORE, BE IT RESOLVED, that the Price County Board of Supervisors duly assembled this 15th day of June, 2010, do hereby designate the Pine Line Recreation Trail (portion located within Price County) as a Price County Park. BE IT FURTHER RESOLVED, that the adoption of a similar resolution by the Taylor County Board of Supervisors is required in order for this resolution to become effective.  The Clerks of each County are directed to exchange certified copies of the respective resolutions and of the action taken thereon by each of the respective County Boards, and to also provide such copies to Marvin Kuenne, President of Price/Taylor Rail Trail Commission, Medford, WI 54451.RESPECTFULLY SUBMITTED BY:  Price County Tourism/Forestry and Parks Committee. Resolution 26-10

Authorizing Price County’s Participation in the Utility Terrain Vehicle Pilot Program

WHEREAS, due to the increasing numbers of utility terrain vehicles (UTV), there is great demand for utility terrain vehicle trails; and WHEREAS, a “Utility Terrain Vehicle Pilot Program” was established in the 2010-2012 State Budget approved through the Wisconsin State Legislature; and WHEREAS, the Department of Natural Resources, in consultation with the Department of Transportation, shall administer this program to investigate the effects of using UTV’s on trails and roadways that are used and authorized to be used by all-terrain vehicles (ATV), to evaluate whether it is feasible and appropriate to expand the allowable use of utility terrain vehicles on ATV trails and/or roadways; and WHEREAS, in this pilot program a utility terrain vehicle will be considered an all-terrain vehicle.  Therefore, all Price County Ordinances that apply to ATV’s and all language within the Price County Forest Comprehensive Plan relating to ATV’s on ATV trails will apply to UTV’s; and WHEREAS, the Department of Natural Resources will register a UTV and collect fees in the same manner as an ATV; and WHEREAS, this resolution applies to all municipalities within Price County.  In the event any municipality within the county wishes to opt out of participation in the pilot program, the municipality shall pass a resolution to that effect; and WHEREAS, this pilot program will end on June 30, 2012.  The County or any municipality may withdraw from the pilot program prior to the end of the program by adopting a resolution to that effect; and THEREFORE, BE IT RESOLVED, that the Price County Board of Supervisors elects to participate in the Utility Terrain Vehicle Pilot Program and approves allowing utility terrain vehicles to use all designated all-terrain vehicle trails and routes in Price County. Price County Airport Six-year Plan

RESOLVED, by the Price County Board of Supervisors that the attached list of proposed improvements are in the best interest of the Price County Airport; and WHEREAS, Wisconsin Statutes require a Statement of Project Intentions from airport owners contemplating federal and/or state aid within the next six years; and WHEREAS, this Six Year Statement of project Intentions is used by the Department of Transportation, Bureau of Aeronautics for planning and budgeting purposes and is not a petition for federal and/or state aid; and NOW, THEREFORE BE IT RESOLVED that this governing body contemplates requesting federal and/or state aid for the projects listed on the attached schedule of airport improvements. Budget Amendments for Fiscal Year Ending December 31, 2010

WHEREAS the Price County Board of Supervisors at their November 10, 2009 meeting, after public hearing, adopted the 2010 budget for Price County, and WHEREAS the Executive/Finance / Information Technology Committee of the Price County Board of Supervisors on May 20, 2010  were advised of changes to transfer money from the County Clerk budget to the Airport budget, and WHEREAS the Wisconsin Statutes 65.90(5)(a)(1) states “A budget…may not be changed unless authorized by a vote of two-thirds of the membership of the governing body of the municipality”, and WHEREAS the proposed amendments recommended by the Price County Executive/Finance / Information Technology Committee does not change the amount of tax levied and the proposed amendments will more accurately record the financial activities of Price County during 2010, BE IT RESOLVED by the Price County Board of Supervisors at their June 15, 2010 meeting that the 2010 budget as adopted be amended to include the following changes:

Authorizing Deedback Transaction of List of Tax Liens for 2009, #43 to Massive Spirit Kennels

WHEREAS in the opinion of the Price County Board of Supervisors, it is for the benefit and in the best interests of the citizens of Price County that real property recently foreclosed by virtue of the List of Tax Liens for 2009 be privately owned such that it may be utilized by the public and returned to the public tax rolls; and WHEREAS Massive Spirit Kennels Estates a/k/a Massive Spirit Kennels has previously owned one such parcel of property, namely, Parcel #43 of the List of Tax Liens for 2009 more particularly described as follows: Parcel 43  A parcel of land located in Government Lot Six (6), Section Thirty-one (31), Township Thirty-four (34) North, Range Three (3) East, Town of Spirit, Price County, Wisconsin, described as follows: Commencing at the Southwest corner of said Government Lot Six (6) as the point of beginning; thence East along the South line of said Government Lot Six (6) 300 feet to a point; thence North 200 feet, parallel with the West line of said Government Lot Six (6) to a point; thence West parallel with said South line of Government Lot Six (6), 300 feet to the West line of said Government Lot Six (6); thence South on the West line of said Government Lot Six (6), 200 feet more or less to the place of beginning. Said Parcel #43 having been transferred to ownership of Price County under the Order for Judgment and Judgment of the Honorable Douglas T. Fox, Price County Circuit Court Judge, on May 10, 2010; and WHEREAS said Massive Spirit Kennels has requested the opportunity to obtain such property back from Price County upon payment of such amounts as deemed necessary. THEREFORE, IT IS RESOLVED that the Price County Clerk is hereby authorized, empowered, and directed to sell in exchange for payment by Massive Spirit Kennels Estates a/k/a Massive Spirit Kennels or any owner of said organization the amount of all currently unpaid taxes (whether delinquent or not) together with any unpaid interest or penalties upon said taxes and the pro rata share of all costs and fees associated with Price County’s acquisition of said parcel and/or Price County’s reasonably incurred expenses in preparation for upcoming land sale, all to be certified by the Price County Treasurer.  Motion made by Rasmussen and seconded by Walasek, that the above resolution be approved. Resolution 30-10

Participation in a Regional Hazard Mitigation Planning Process

WHEREAS, ­­­­­­­­­­­­­­­­­­Price County desires to participate in the development of a regional hazard mitigation plan as established under the Hazard Mitigation Act of 2000; and WHEREAS, ­­­­­­­­­­­­­­­­­­Price County authorizes the Northwest Regional Planning Commission (NWRPC) to submit an application to the Pre-Disaster Mitigation Grant Program (PDM) on behalf of  ­­­­­­­­­­­­­­­­­­Price County and it’s project partners to develop a  Regional Hazard Mitigation Plan; and WHEREAS, the Regional Hazard Mitigation Plan shall be an intergovernmental planning process including all local governmental units in ­­­­­­­­­­­­­­­­­­Price County; and WHEREAS, the Act, as part of the planning process, requires public involvement and local coordination among neighboring local units of government and businesses; and WHEREAS, the plan must include a risk assessment including past hazards, hazards that threaten the county, maps of hazards, an estimate of structures at risk, estimate of potential dollar losses for each hazard, a general description of land uses and development trends; and WHEREAS, the plan must include a mitigation strategy including goals and objectives and an action plan identifying specific mitigation projects and costs; and WHEREAS, the plan must include a maintenance or implementation process including plan updates, integration of plan into other planning documents and how the County will maintain public participation and coordination; and WHEREAS, approval of the hazard mitigation plan will make the county eligible to receive Hazard Mitigation Grant Program (HMGP) project grants; and WHEREAS, the draft plan will be shared with Wisconsin Emergency Management (WEM) for coordination of state agency review and comment on the draft. NOW THEREFORE BE IT RESOLVED, that Price County is committed to completing a Regional Hazard Mitigation Plan and to support the Northwest Regional Planning Commission’s application to the Pre-Disaster Mitigation Grant Program. BE IT FURTHER RESOLVED, that Price County agrees to participate in the preparation of a Regional Hazard Mitigation Plan for Price County and designates the Northwest Regional Planning Commission as the planning agency responsible for the preparation of the plan. Town of Catawba Bridges Aid Request

Honorable County Board Members: The Town of Catawba is requesting Federal Aid for design and construction of bridge (P50-0087) on Hobbles Creek Road over Hobbles Creek. The funding criteria for the above mentioned project is as follows:  Design: 80% Federal Aid, 20% Town of Catawba. Construction: 80% Federal Aid, 10% Town of Catawba, 10% Price County. Amend County Fee Schedule – Zoning

WHEREAS, Chapter 59.69 Wis. Stats. provides the authority for the Price County Board of Supervisors to promote public health, safety and general welfare within the limits of the county by creating Zoning Ordinances; and WHEREAS, The Price County Zoning Ordinances require permits for specific land use activities to ensure land use activities do not adversely affect public health, safety and general welfare; and WHEREAS, Documents are required to be recorded with the Price County Register of Deeds to record specific information as part of an application required by the Price County Zoning Ordinances; and WHEREAS, 2009 Wisconsin Act 314 was passed into law wherein recording fees will increase on June 25, 2010; NOW THEREFORE BE IT RESOLVED, the Price County Board of Supervisors by adoption of this resolution amends the fees for all items listed on the attached document to reflect the increase in recording fees as a result of 2009 Wisconsin Act 314. Spending/Funding Proposal.  Motion Laws/Schneider to use the contingency fund to offset any non-budgeted expenses incurred by departments for services associated with the Log Jam.  Motion carried on voice vote.  c. Resolution – none.  2. 2011 Budget.  a. 2003-2011 financial data presented by Mr. Kopisch.  b. Establish 2011 budget parameters and priorities.  Motion Walasek/Janssen to set the budget at a zero percent levy increase. Roll call vote: Yes (10): Rogalla, Walasek, Kardas, Robb, Schneider, Rasmussen, Janssen, Vlach, Kapitz, Laws; No (2): Palecek, Heikkinen; Motion carried. Committee consisting of Rogalla, Walasek, Kardas, Vlach, Janssen to study different sources of revenue.  c. Elections and Appointments:  1.    Board of Adjustment – Three year term expiring June 30, 2013 (Dan Haupert, James Yunk-1st Alt).  Motion Laws/Robb to appoint Dan Haupert and James Yunk to the Board of Adjustment with terms to expire June 30, 2013.  Motion carried. 2. LEPC Committee Appointment (all committee members).  Motion Janssen/Robb to accept list of LEPC Committee appointments as presented.  Motion Rogalla/Walasek to remove John Vlach as the second County Board Supervisor representative on list submitted. Roll call vote: Yes (7): Rogalla, Walasek, Kardas, Robb, Heikkinen, Kopisch, Kapitz; No (6): Palecek, Schneider, Rasmussen, Janssen, Vlach, Laws; Motion carried. 3. ADRC Regional Board Member – Remainder of three year term expiring May 31, 2012 (Carol McLaughlin).  Motion Robb/Heikkinen to appoint Carol McLaughlin to the ADRC Regional Board.  Motion carried. 4.
