Resolution 24-09

Establish a Fee for Shoreland Mitigation Plans

WHEREAS, The Price County Board of Supervisors has the authority to establish fees for services to help relieve the tax levy; and WHEREAS, The Price County Land Conservation Department works in conjunction with the Price County Zoning Department to develop shoreland restoration plans for landowners that violate Price County’s Shoreland Ordinance; and WHEREAS, The Price County Land Conservation Department does not currently charge a fee for such service and is expending taxpayer dollars to assist someone violating an ordinance rather than assisting someone who voluntarily requests plans; and WHEREAS, The Price County Ag-Extension Education / Land Conservation Committee have reviewed the matter and believe a fee should be charged to develop a mitigation plan to be used as part of an enforcement action; NOW THEREFORE BE IT RESOLVED, The Price County Board of Supervisors establishes a fee of $300 to be charged for the Price County Land Conservation Department to develop a shoreland mitigation plan as part of enforcement action being sought by the Price County Zoning Department for violation of the Price County Shoreland Ordinance. Farmland Preservation Agreement Application

WHEREAS, the Price County Board of Supervisors have adopted a farmland preservation plan for Price County in order to provide tax relief to local farmers and encourage continued agricultural use and conservation of the land; and

WHEREAS, the following landowner has applied for a new Farmland Preservation Agreement under the law, Chapter 91, Wis. Stats. To the Wisconsin Department of Agriculture, Trade & Consumer Protection, and WHEREAS, the applicant has met the criteria set forth in s 91.13(4), Wis. Stats. NOW THEREFORE BE IT RESOLVED, that the Price County Board of Supervisors approves the application for a Farmland Preservation Agreement submitted by the following individuals. Mark A. Resolution 26-09

Amend the Price County Zoning Ordinance 4-79, Section 20.0

WHEREAS, Chapter 59, Wisconsin Statutes require that the Zoning Committee hold a public hearing and report to the Price County Board of Supervisors on all petitions to amend Zoning Ordinances or Zoning District Maps; and

WHEREAS, the Price County Board of Supervisors must then act upon the recommendation of the Zoning Committee, either approving or disapproving or returning the petition with changes recommended by the Price County Board of Supervisors, and WHEREAS, the Zoning Committee has held a public hearing and hereby recommends that the Price County Board of Supervisors ratify the amendment attached; NOW THEREFORE BE IT RESOLVED, that the Price County Board of Supervisors approve the amendment to the Price County Zoning Ordinance 4-79, Section 20.0 regarding the Price County Board of Adjustment. REVISION

SECTION 20.0 BOARD OF ADJUSTMENT

20.1              COMPOSITION

There shall be a Board of Adjustment consisting of five members to be appointed by the Chairman of the County Board with the approval of the County Board.  The terms of the first five members so appointed shall be for one, two, and three years, respectively.  Successors shall be appointed in like manner at the expiration of each term and their terms of office shall be three years in all cases, beginning July 1 in the year in which they are appointed and until their successors are appointed.  The members of the Board of Adjustment shall all reside within the county and outside the limits of incorporated cities and villages; provided, however, that no two members shall reside in the same town.  The Board of Adjustment shall choose its own chairman.  Vacancies shall be filled for the unexpired term of any member whose term becomes vacant in the same manner as the original appointment.

The Office of the Board of Adjustment shall be in the County Clerks   office.(Amended at the May 14, 2009 Zoning Committee Meeting)

20.2         RULES

A.       CALL FOR MEETINGS

The Board of Adjustment shall meet at the call of the chairman, and at such other times as the Board of Adjustment may determine, at a fixed time and place.

B.       OPEN MEETINGS

All meetings of the Board of Adjustment shall be open to the public.

C.       PUBLIC HEARING LOCATION

Any public hearing which the Board of Adjustment is required to hold under Section 20.4 Power and Duties of the Board of Adjustment shall be held in a town hall or other place as convenient as may be to the location or locations to be considered at such public hearing, and a full description of the location or such place of hearing by name, address, or other commonly known means of identification, shall be included in the notice given of such hearing.

D.       NOTIFICATION OF PUBLIC HEARING

Notice of any public hearing which the Board of Adjustment is required to hold under the terms of this Ordinance shall specify the date, time, and place of hearing and the matter to come before the Board of Adjustment at such hearing, and such notice shall be given the following way:

1.        By publication of a Class II notice in the official newspaper of the County; the last notice must not be less than seven days prior to the date of the hearing.

E.       MINUTES

The Board of Adjustment shall keep minutes of its proceedings showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact, and shall keep records of its examinations and other official actions in the office of the Board of Adjustment, all of which shall be public record.

F.        PERFORMANCE OF DUTIES

The Board of Adjustment shall have power to call on any County departments for assistance in the performance of its duties and it shall be the duty of such other departments to render all such assistance as may be reasonably required.

G.       EFFECTUATION

The Board of Adjustment may adopt such rules as are necessary to carry into effect the regulations of the County Board.

H.       CERTIORARI

In the case of all appeals, the Board of Adjustment shall call upon the County Zoning Committee for all information pertinent to the decision appealed from.

20.3         APPEALS TO THE BOARD

A.       Appeals to the board of adjustment may be taken by any person aggrieved or by any officer, department, board or bureau of the municipality affected by any decision of the building inspector or other administrative officer. Such appeal shall be taken within a reasonable time, as provided by the rules of the board of adjustment, by filing with the officer from whom the appeal is taken and with the board of adjustment a notice of appeal specifying the grounds thereof. The officer from whom the appeal is taken shall forthwith transmit to the board of adjustment all the papers constituting the record upon which the action appealed from was taken.

B.       STAYS.  An appeal shall stay all proceedings in furtherance of the action appealed from, unless the officer from whom the appeal is taken shall certify to the board of adjustment after the notice of appeal shall have been filed with that officer that by reason of facts stated in the certificate a stay would cause imminent peril to life or property. In such case proceedings shall not be stayed otherwise than by a restraining order, which may be granted upon application to the board of adjustment or by petition to a court of record, with notice to the officer from whom the appeal is taken.

C.       HEARING APPEALS. The board of adjustment shall fix a reasonable time for the hearing of the appeal and publish a class 2 notice thereof under ch. 985, as well as give due notice to the parties in interest, and decide the same within a reasonable time.  Upon the hearing, a party may appear in person or by agent or attorney. In an action involving a historic property, as defined in s. 44.31 (3), the board of adjustment shall consider any suggested alternatives or recommended decision submitted by the landmarks commission or the planning and zoning committee or commission.

20.4               POWERS OF BOARD.

A.       To hear and decide appeals where it is alleged there is error in an order, requirement, decision or determination made by an administrative official in the enforcement of s. 59.69 or of any ordinance enacted pursuant thereto.

B.       To hear and decide special exceptions to the terms of the ordinance upon which the board is required to pass under such ordinance.

C.       To authorize upon appeal in specific cases variances from the terms of the ordinance that will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions of the ordinance will result in unnecessary hardship, and so that the spirit of the ordinance shall be observed and substantial justice done.

D.       To grant special exceptions and variances for renewable energy resource systems. If the board denies an application for a special exception or variance for such a system, the board shall provide a written statement of its reasons for denying the application.  In this paragraph, “renewable energy resource system” means a solar energy system, a waste conversion energy system, a wind energy system or any other energy system which relies on a renewable energy resource.

Resolution 27-09

Opposing Proposed Changes to Wisconsin’s Prevailing Wage Law

WHEREAS, the Governor’s proposed biennial state budget, Assembly Bill 75, proposes to make the prevailing wage law applicable to any public works contract over $2,000; and, WHEREAS, under current law the prevailing wage requirements only apply to multiple-trade public works projects over $234,000 and single trade public works projects over $48,000; and, WHEREAS, reducing the threshold to $2,000 will increase the cost of small public works

projects previously exempted from the prevailing wage requirement in many communities; and, WHEREAS, the cost increase to pay prevailing wages on all public works projects over $2,000 will force counties and other local governments to reduce the number and/or size of public works projects or raise taxes to meet the increased costs, which would further burden property taxpayers; and, WHEREAS, the Governor’s proposed budget also for the first time proposes to make the prevailing wage law applicable to private projects that receive public financing; and, WHEREAS, the requirement to pay prevailing wages on all public works projects over $2,000 will take away the competitive advantage that many smaller local contractors have on smaller public works projects over larger contractors from outside a local community, thus hurting the local economy in these communities while still increasing the costs of these projects; and, WHEREAS, these proposed changes to the prevailing wage law would substantially increase costs to Price County over the next two years at a time when Price County is operating under numerous financial constraints including proposed levy limits and tax rate limits; and, WHEREAS, the proposed changes to the prevailing wage law in the budget are non-fiscal policy items that should be addressed as separate legislation so that lawmakers can give more thoughtful consideration to changing the cost threshold for public works projects and clarifying statutory language to distinguish between routine maintenance and construction projects. NOW, THEREFORE BE IT RESOLVED,  that the Price County Board of Supervisors opposes the changes to the prevailing wage law proposed in AB 75, and urges the Legislature and the Governor to remove these items from the budget bill. WHEREAS the Price County Board of Supervisors at their November 13, 2007 meeting, after public hearing, adopted the 2008 budget for Price County, and WHEREAS the Executive/Finance / Information Technology Committee of the Price County Board of Supervisors on May 21, 2009 were advised of changes to the revenues which have been made available to the Commission on Aging and Human Services departments, and WHEREAS the Wisconsin Statutes 65.90(5)(a)(1) states “A budget…may not be changed unless authorized by a vote of two-thirds of the membership of the governing body of the municipality”, and WHEREAS the proposed amendments recommended by the Price County Executive/Finance / Information Technology Committee does not change the amount of tax levied and the proposed amendments will more accurately record the financial activities of Price County during 2008, BE IT RESOLVED by the Price County Board of Supervisors at their June 16, 2009 meeting that the 2008 budget as adopted be amended to include the following changes:

Amendment to Price County Fee Schedule Regarding Appeals to the Board of Adjustment

WHEREAS, Chapter 59.69 Wis. Stats. Provides the authority for the Price County Board of Supervisors (Board) to promote health, safety and general welfare within the limits of the County by creating a Zoning Committee and adopting a Zoning Ordinance, and WHEREAS, Chapter 59.694 Wis. Stats, provides the authority for the Board to appoint a Board of Adjustment: a) to hear and decide appeals where it is alleged there is error in an order, requirement, decision or determination made by an administrative official in the enforcement of Chapter 59.69 Wis. Stats. or of any ordinance enacted pursuant thereto, b) to hear and decide special exceptions to the terms of the ordinance upon which the board is required to pass under such ordinance and c) to authorize upon appeal in specific cases variances from the terms of the ordinance that will not be contrary to the public interest, where owing to special conditions, a literal enforcement of the provisions of the ordinance will result in unnecessary hardship, and so that the spirit of the ordinance shall be observed and substantial justice done, and WHEREAS, Chapter 59.697 Wis. Stats. provides the authority for the Board to establish a schedule of fees to be charged for the filing of petitions for amendment and notices of appeal under ss. 59.69 and 59.694 relating to zoning ordinances, and WHEREAS, the Board has duly adopted a fee schedule for appeals to the Board of Adjustment, most recently as the revision adopted on October 17, 2006, and WHEREAS, such Board of Adjustment (BOA) fee has been charged regularly and consistently for appeals to the BOA, and WHEREAS, the language of “appeal” and “variance” has been used interchangeably to refer to appeals to the BOA, NOW THEREFORE BE IT RESOLVED, that, in order to eliminate the confusing language contained in the fee schedule adopted on October 17, 2006, the fee schedule be changed, as attached, to reflect past practice and the intent of the Board to establish a fee for appeals to the Board of Adjustment of $500.00 without regard to the specific purpose of the appeal. 2008 Transfer into Capital Improvement Fund

WHEREAS, the Price County Board of Supervisors approved resolution #33-07, Capital Improvement Fund, at a regular meeting held August 21, 2007, and WHEREAS, resolution #33-07 calls for providing a funding mechanism in development of a Capital Improvement Fund as set forth:  20% of County sales tax revenues or ½ of the excess of General Fund (100) Revenues over General Fund (100) Expenditures for the fiscal year after adjustments for continued appropriations (carryovers), whichever is greater. WHEREAS, the sales tax revenue for 2008 was $766,324 which would provide $153,264 as per above provision, and WHEREAS, the audited General Fund revenues for 2008 were $8,061,445 and General Fund expenses for 2008 were $8,019,202 resulting in an excess of $42,243 of which $423,423 in continued appropriations has been deducted leaving a net ($381,180) which would provide $0 as per above provision. NOW THEREFORE BE IT RESOLVED, that the greater amount of $153,264 be transferred from the General Fund into the Capital Improvement Fund for the year 2008. Resolution 32-09

Opposing 2009 AB 149 Interest Rate Reduction on Delinquent Property Taxes

WHEREAS, the 2009 Assembly Bill 149 would temporarily reduce the interest rate on delinquent general property taxes from 1% to .5% per month from the time the bill would be enacted until December 31, 2010; and WHEREAS, if the proposed change had been in effect for 2008, Price County would have lost  $59,520.14 in revenue; and WHEREAS, the term "interest" is actually a penalty imposed for people who do not obey the law and do not pay their property taxes, similar to State penalties for nonpayment of State income tax, interest is in lieu of sending people to court or jail for violating the law; and WHEREAS, it seems inequitable to lower the interest rate for delinquent property taxpayers, and leave the penalty for nonpayment of State Income and Sales tax untouched; and WHEREAS, Price County works with their taxpayers through allowing monthly payments in which the majority of the taxpayers pay their taxes prior to foreclosure; and WHEREAS, the additional costs and reduction in revenue that will result if this proposal is adopted could only be offset by a reduction in county services or an increase in property taxes to those taxpayers that pay taxes timely, or both; and WHEREAS, revenue generated from the interest of collected delinquent property taxes works to offset the cost of courtesy letters, notices and publications that are all a part of the collection process mandated by State statute; and WHEREAS, the counties still continue settling in full for the levies of all taxing jurisdictions regardless of the amount of taxes collected; and WHEREAS, a temporary reduction in the interest rate charged on delinquent taxes is not a solution that will provide meaningful long-term relief to the vast majority of taxpayers and will create confusion when the original interest rate is reinstated; NOW THERFORE BE IT that the Price County Board of Supervisors hereby opposes any Legislative proposal to reduce the interest rate charged on delinquent property taxes. BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded by the County Clerk to Governor Doyle and Price County’s representatives in the Wisconsin State Senate and Assembly.  Dated this 11th day of June, 2009. Increase Civil Process Fees

WHEREAS, Section 814.70, Wisconsin Statutes, sets for fees the Sheriff shall collect for service of process, execution on a judgment and travel for civil process; and WHEREAS, presently the fee for service of process is $30 for each defendant or person, or, if there is more than one defendant or person served at the same address, $15 for each additional person, WHEREAS, Section 814.705, Wisconsin Statutes, allows a county to establish a higher fee than set forth above; NOW, THEREFORE, BE IT RESOLVED, by the Price County Board of Supervisors that the following schedule be and is hereby established regarding civil process fees: 1. The service of process fee shall be $65 for service for up to three (3) attempts at service for each person to be served. Prepayment of civil process fees shall be required. 2. The fee for travel for civil process shall be the Internal Revenue Service’s mileage rate in effect at the time for each mile actually and necessarily traveled. 3. A fee of $5 shall be charged for each address verification requested through the US Postal Service. 4. The fee for Sheriff’s Sales shall be $75 for posting and $75 for the sale. BE IT FURTHER RESOLVED, that this new civil process fee schedule will take effect with those documents served after January 1, 2010. Adopting Recommendations of Department Consolidation Committee

WHEREAS, a committee was established, per direction of the Price County Board, to review possible consolidations within the County in order to reduce costs; AND WHEREAS, this committee identified several areas where consolidation would be of benefit to the County; AND WHEREAS, this committee has developed a recommendation for the Board to adopt three separate proposals for implementation as of a date or dates to be determined by the Board; AND WHEREAS, adopting these proposals would be in the best interests of Price County and its citizens by serving to reduce the cost of operating Price County government; NOW THEREFORE BE IT RESOLVED, that the Price County Board of Supervisors adopt the following three proposals with an effective date as defined below: 1. Consolidate the Airport Department with the Highway Department effective April 13, 2010 under the jurisdiction of the Highway Committee and thereby eliminating the Airport Committee; AND 2. Transfer the jurisdiction of the Land Conservation Department effective April 13, 2010 to a newly formed committee to serve as a Land Conservation committee created per WI State Statute 92.06 and to include the current responsibility of the committee of jurisdiction for Forestry & Parks and Tourism and transfer the clerical support function for the LCD from the UWEX Department to the Forestry Department and thereby reduce the affected clerical position within the UWEX Department to ½ time; AND 3. Direct the Executive/Finance/IT Committee to develop a vehicle and equipment purchasing policy effective April 13, 2010 January 1, 2010 to eliminate the future purchasing of duplicative County vehicles and equipment;

Estimated fiscal impact:  Range of $29,450 - $38,300/year excluding unemployment costs and any future benefits from the vehicle/equipment purchasing policy.  Dated this 11th day of June, 2009. Resolution 35-09

Consolidation of the Human Services Department with the Health Department

WHEREAS, on November 13, 1990, the Price County Board of Supervisors (Board) established a Price County Human Services Department in accordance with Section 46.23(3)(a) of the Wisconsin State Statutes; AND WHEREAS, on April 19, 1994, the Board established the Price County Health Department and the Price County Board of Health in accordance with Section 251.02(1) of the Wisconsin State Statutes; AND WHEREAS, the Board may transfer the powers and duties of a local board of health, a local health officer and local health department to the county department of human services as defined in Wisconsin State Statutes 46.23(3)(am)(4)(b)(1)(b)(bm)(c); AND WHEREAS, the Board on April 21, 2009 directed a committee to be formed to review the consolidation of the Human Services Department and the Health Department and present a recommendation to the Board at its June 16, 2009 meeting; AND WHEREAS, said committee was formed and has conducted a review of the consolidation of the Human Services Department and the Health Department; AND WHEREAS, per the review of the above committee, due to economic, structural and organization benefits to Price County, it is recommended that the Health Department be consolidated with the Human Services Department to form a newly named Price County Health and Human Services Department; NOW THEREFORE BE IT RESOLVED that the Human Services Department and the Health Department be consolidated into a newly formed Price County Health and Human Services Department with a target effective date of January 1, 2010; AND BE IT FURTHER RESOLVED that a planning committee of no more than nine members composed of both elected and non-elected persons be formed to develop an implementation plan for the operation of the Price County Health and Human Services Department and for the establishment of a Price County Health and Human Services Board to be presented to the Board for approval no later than at its November 2009 meeting with appointment to such committee made by the County Board Chair; AND BE IT FURTHER RESOLVED that the planning committee is responsible for developing a plan that will assure that the integrity and the effectiveness of the current public health programs are maintained and that the requirements of Wisconsin State Statutes 46, 250, 251, regarding the organization and operation of both human services and health departments, shall be met. Estimated fiscal impact: Savings of at least 2-3% of the estimated 2010 gross expenditures of the consolidated departments of $6.4 million or approximately $128,000-$192,000/year attained over a two to four-year period.
