9:05 a.m. Public Hearing: Conducted by John Strochine from Northwest Regional Planning Commission.  Explanation of the Community Development Block Grant Program including goals, objectives, application process, amount of funds available, timetable, eligible activities.  Explanation of Price County’s development needs, objectives and strategies.  Discussion of the United Pride Dairy, LLC. project.  All interested citizens are invited to attend the public hearing and provide input on this Economic Development project.  Also present John Pesko and Ed Jesurdas from Pure Dairy, LLC.  No public comments.  Chair Kopisch declared hearing closed at 9:25 a.m.

Resolution 33-10

Authorizing Submission of a CDBG-MVP-Ed Application

Relating to the County of Price’s participation in the Wisconsin Community Development Block Grant for Economic Development program.  WHEREAS, Federal monies are available under the Community Development Block Grant program, administered by the State of Wisconsin, Department of Commerce, for the purpose of Milk Volume Production for Economic Development; and  WHEREAS, after public meeting and due consideration, the Price County Board has recommended that an application be submitted to the State of Wisconsin for the following project: The economic expansion of the United Pride Dairy, LLC in the Town of Worcester; and WHEREAS, it is necessary for the Price County Board, to approve the preparation and filing of an application for the County to receive funds from this program; and WHEREAS, the Price County Board has reviewed the need for the proposed project and the benefit(s) to be gained there from; NOW, THEREFORE, BE IT RESOLVED, that the County Board does approve and authorize the preparation and filing of an application for the above-named project; and the County Board Chairman is hereby authorized to sign all necessary documents of behalf of the County; and that authority is hereby granted to the Northwest Regional Planning Commission to take the necessary steps to prepare and file the appropriate application for funds under this program in accordance with this resolution. Resolution 34-10

2009 Transfer into Capital Improvement Fund

WHEREAS, the Price County Board of Supervisors approved resolution #33-07, Capital Improvement Fund, at a regular meeting held August 21, 2007, and WHEREAS, resolution #33-07 calls for providing a funding mechanism in development of a Capital Improvement Fund as set forth:

·          20% of County sales tax revenues or ½ of the excess of General Fund (100) Revenues over General Fund (100) Expenditures for the fiscal year after adjustments for continued appropriations (carryovers), whichever is greater.

WHEREAS, the sales tax revenue for 2009 was $742,692 which would provide $148,538 as per above provision, and

WHEREAS, the audited General Fund revenues for 2009 were $7,316,210 and General Fund expenses for 2009 were $8,096,863 resulting in an excess of $(780,653) of which $74,007 in continued appropriations has been deducted leaving a net $(854,660) which would provide $0.00 as per above provision. NOW THEREFORE BE IT RESOLVED, that the greater amount of $148,538 be transferred from the General Fund into the Capital Improvement Fund for the year 2009. Budget Amendments for Fiscal Year Ending December 31, 2010

WHEREAS the Price County Board of Supervisors at their November 10, 2009 meeting, after public hearing, adopted the 2010 budget for Price County, and WHEREAS the Executive/Finance / Information Technology Committee of the Price County Board of Supervisors on July 29, 2010  were advised of changes to the revenues which have been made available to the Emergency Government, Commission on Aging and Health departments, and WHEREAS the Wisconsin Statutes 65.90(5)(a)(1) states “A budget…may not be changed unless authorized by a vote of two-thirds of the membership of the governing body of the municipality”, and WHEREAS the proposed amendments recommended by the Price County Executive/Finance / Information Technology Committee does not change the amount of tax levied and the proposed amendments will more accurately record the financial activities of Price County during 2010, BE IT RESOLVED by the Price County Board of Supervisors at their August 17, 2010 meeting that the 2010 budget as adopted be amended to include the following changes:

Resolution 36-10

Policy to Eliminate Duplicative Vehicle and Equipment

WHEREAS, the Price County Board of Supervisors is tasked with continually monitoring County revenue and expenses and developing means to be financially responsible with tax levy funds, and WHEREAS, Per Price County Resolution #34-09: “Direct the Executive/Finance/IT Committee to develop a vehicle and equipment purchasing policy effective January 1, 2010 to eliminate the future purchase of duplicative County vehicles and equipment”, and

WHEREAS, it is in the best interest of the County to promote the following vehicle and equipment use and purchase protocol. Committees of Jurisdiction will:

·          Scrutinize the necessity of making a major vehicle or equipment purchase.

·          Search out availability of sharing vehicles and equipment with other departments before purchasing or authorizing major repair of existing vehicle or equipment.

·          Review the inventory of existing vehicles and equipment and sell or dispose of any that is no longer being used (according to Price County Policy). 

·          Work with other departments to see if there is equipment that could be shared and eliminate duplicate equipment.

NOWTHEREFORE BE IT RESOLVED, that the Price County Board of Supervisors adopt the above policy and protocol to promote the elimination of surplus and duplicative County vehicles and equipment.

Resolution 37-10

Supporting the Legislative Council Study on MFL Program

WHEREAS, Federal, State and County Forest along with property in the Managed Forest Land (MFL) program make up 49% of Price County; and WHEREAS, the loss of revenue and compensation to counties where counties receive 20% or .33/acre of the acreage share payment on MFL closed and .13/acre on MFL open for a total of $58,968.94 compared to $942,111.70 (total assessed value x  mil rate); and WHEREAS, there is an increase in property being enrolled in MFL program, (270,000 acres privately owned forest land with 120,000 currently signed up for MFL), as real estate taxes rise therefore shifting the tax burden to the residential and commercial properties; and WHEREAS, nothing is paid toward the school levies by properties in the MFL program;  and WHEREAS,currently property taxes do not have to be paid in full on a parcel that a cutting permit is being issued. To prevent tax delinquency after timber is harvested, taxes should be paid in full prior to cutting permit issuance; and WHEREAS, buildings located on managed forest lands are taxed as personal property buildings on leased land rather than real estate,  NOW THEREFORE BE IT that the Price County Board of Supervisors support the Legislative Council study of the MFL program. Authorizing Deedback Transaction of List of Tax Liens for 2009, #39 to Kathie M. Kramer

WHEREAS, in the opinion of the Price County Board of Supervisors, it is for the benefit and in the best interests of the citizens of Price County that real property recently foreclosed by virtue of the List of Tax Liens for 2009 be privately owned such that it may be utilized by the public and returned to the public tax rolls; and WHEREAS, Kathie M. Kramer has previously owned one such parcel of property, namely, Parcel #39 of the List of Tax Liens for 2009 more particularly described as follows: Parcel 39: A parcel of land located in the Northeast Quarter (NE ¼) of the Northwest Quarter (NW ¼), Section Eight (8), Township Thirty-five (35) North, Range One (1) West, Village of Catawba, Price County, Wisconsin, described as follows: Commencing at a point 33 feet East of the Southwest corner of the NE NW, 8-35-1 West of the 4th principal meridian in Wisconsin; thence North parallel to the North and South 1/8th line and 33 feet East thereof, a distance of 699.44 feet, thence North 83° 13’ East a distance of 74.5 feet, thence South 2° 47’ East a distance of 175 feet; thence North 83° 13’ East a distance of 85 feet, thence South parallel to North and South 1/8 line to the South line of the NE NW, of the aforesaid section, thence West along the aforesaid South line 174 feet to the place of beginning according to the above described survey; EXCEPT a parcel described in Volume 112 of Deeds on page 302, EXCEPT a parcel described in Volume 120 of Deeds on page 198 and EXCEPT a parcel described in Volume 90 of Deeds on page 549. Kramer the amount of all currently unpaid taxes (whether delinquent or not) together with any unpaid interest or penalties upon said taxes and the pro rata share of all costs and fees associated with Price County’s acquisition of said parcel and/or Price County’s reasonably incurred expenses in preparation for upcoming land sale, all to be certified by the Price County Treasurer. Resolution 39-10

Requirement of Act 314 for Register of Deeds Office - Redaction of Social Security Numbers

WHEREAS, 2009 Wisconsin Act 314, changes in part the fees collected by the Register of Deeds and requires the redaction of social security numbers from electronic documents on the Internet and WHEREAS, 2009 Wisconsin Act 314, allows for an additional $5.00 fee per document commencing June 25, 2010, if the $5.00 is used for the redaction of social security numbers from electronic documents, and  WHEREAS, creating a Non-Lapsing account would reserve the $5.00 fee collected to be used for redaction purposes only as required by law, and WHEREAS, the Non-Lapsing account would terminate when the redaction is complete and the $5.00 fee is no longer collected,  BE IT RESOLVED, that the Register of Deeds take reasonable measures with electronic format records so that social security numbers are not viewable or accessible on the internet and that the extra $5.00 statutory recording fee be used for that purpose. BE IT FURTHER RESOLVED, that the PRICE County Board Supervisors does hereby create a Non-Lapsing revenue account # 100-00-23750-000-000 in 2010 and future years for the uses specified in Act 314. Establishment of Highway Department Bridge Funding Reserve

Whereas, the Price County Highway Department periodically budgets for the costs of bridge maintenance projects throughout the County as part of its annual budget, and Whereas, since 2003, $71,700.00 has been budgeted but not spent for specific bridge maintenance projects, and Whereas, in 2009, as part of the American Reinvestment and Recovery Act of 2009 (ARRA), federal funding was received for the entire cost of the budgeted bridge maintenance projects allowing for completion of those projects, and Whereas, the funds budgeted and allocated from the tax levy in the amount of $71,700.00 remain unspent and included in the Highway Department net assets as of 12/31/09 as unrestricted net assets, and Whereas, the Highway Department will continue to be required to do maintenance on Price County bridges in the future, Now Therefore Be It Resolved, that the amount of $71,700.00 be established as a reserved portion of the Highway Department net assets to be used exclusively for future bridge maintenance projects, and thus eliminate the need for additional tax levy, until such time as the reserved funds have been depleted. Referendum Question on November Ballot (Highway)

WHEREAS, according to the Legislative Fiscal Bureau, over the past decade, the state of Wisconsin has transferred approximately $1.2 billion from the state’s segregated transportation fund to the state’s general fund and replaced it with approximately $800 million in General Obligation (GO) bonds. Thereby, reducing the amount available for transportation purposes by approximately $400 million. WHEREAS, Wisconsin’s practice of transferring money from the segregated transportation fund to the general fund has eroded the public’s confidence that the “user fees” they pay through the state gasoline tax and vehicle registration fees will be used for their intended purpose; and WHEREAS, Wisconsin’s practice of replacing the dollars transferred from the state’s segregated transportation fund with GO bonds puts our state in the precarious position of bonding to fund ongoing operations; and WHEREAS, the Pew Center on the States recently released a report that included Wisconsin as having one of the ten worst budget situations in the country and specifically cited transferring money from the transportation fund to fund ongoing operations as an example of one of the practices that has put Wisconsin in such an untenable position; and WHEREAS, the debt service for these bonds will have to be paid for out of the state’s general fund which hinders its ability to fund other programs like Shared Revenue, Youth Aids, Community Aids and courts in the future; and WHEREAS, using the states general obligation (GO) bonds in this way has hurt the state’s bond rating. A report issued by CNN in 2009 listed Wisconsin as having the second worst GO bond rating in the country; and WHEREAS, gas tax and vehicle registration fees comprise over 90% of the state’s segregated transportation account. Revenues from these two sources have been declining and are inadequate to meet the existing transportation needs in this state; and WHEREAS, Wisconsin’s transportation infrastructure is a fundamental component in its ability to attract and retain business and produce jobs; and WHEREAS, the citizens of Price County deserve the right to have their voices heard on this important issue; and WHEREAS, providing constitutional protection much like our neighbors in Minnesota, Iowa, Michigan and Ohio already have is the only way to ensure that this practice will not continue; NOW, THEREFORE, BE IT RESOLVED by the Price County Board of Supervisors that the following question will be put to the voters of Price County in an advisory referendum during the November 2010 election: Should the Wisconsin Constitution be amended to prohibit any further transfers or lapses from the segregated transportation fund? and; BE IT FURTHER RESOLVED that the County Clerk is directed to cause a copy of the Notice of Referendum to be published in the county’s official newspaper as required by law; and BE IT FURTHER RESOLVED that the County Clerk is directed to provide a copy of this resolution and a copy of the results of the advisory referendum to the Wisconsin Counties Association. Resolution 42-10

Price County Conservation Aids Program

WHEREAS, Price County desires to participate in county fish and game projects pursuant to provision of section 23.09(12) of the Wisconsin Statutes; WHEREAS, financial aid is required to carry out the program;  THEREFORE, BE IT RESOLVED, that Price County has budgeted a sum sufficient to complete the project or acquisition, and;

HEREBY AUTHORIZES the Price County Forest and Parks Administrator, Forestry and Parks Department to act on behalf of Price County to:

·          Submit an application to the State of Wisconsin Department of Natural Resources for any financial aid that may be available;

·          Submit reimbursement claims along with necessary supporting documentation within one (1) year of project ending date;

·          Submit signed documents; and

·          Take necessary action to undertake, direct, and complete the approved project.

BE IT FURTHER RESOLVED that Price County will comply with state or federal rules for the programs and will obtain from the State of Wisconsin Department of Natural Resources approval in writing before any change is made in the use of the project site. Resolution 43-10

County Approval of an Amendment to the Town of Worcester Zoning Ordinance

WHEREAS, the Town of Worcester has undertaken the obligation and authority to control zoning and land use planning to the extent that such authority is granted to the Town pursuant to Wisconsin Statues; and WHEREAS, the County of Price and the Town of Worcester have entered into a Memorandum of Understanding whereby the County and Town have agreed upon the division of such zoning and land use planning authority; and WHEREAS, the Town of Worcester has adopted a Zoning Ordinance, which has been approved by the County of Price and which is currently in force; and WHEREAS, the Town of Worcester has duly amended said Zoning Ordinance 07062010 pursuant to Wisconsin Statues, Section 60.61, by adopting on July 9,2010 a revision to the Zoning District Map for the Town of Worcester upon land owned by Peter E. Zohimsky located in the N ½ of the SW ¼ NW ¼, Section 20, Township 37 North, Range 1 East , a copy of which is attached hereto, and has certified such amendment and hereby seeks to obtain approval of such amendment by the County Board pursuant to Wisconsin Statutes, Section 60.23(3); and WHEREAS, the County Board is satisfied that the attached amendment does not constitute an abuse of discretion, excess of power or error of law by the Town; THEREFORE, BE IT RESOLVED that the amended Zoning District Map for the Town of Worcester Zoning Ordinance adopted by the Town Board on  July 9, 2010 and attached hereto is hereby approved by the County Board of the County of Price. IT IS FURTHER RESOLVED that this approval shall not be effective until this Resolution is published. Recommended this 12th day of August, 2010

Amend the Price County Zoning Ordinance 4-79

WHEREAS, Chapter 59, Wisconsin Statutes require that the Zoning Committee hold a public hearing and report to the Price County Board of Supervisors on all petitions to amend Zoning Ordinances or Zoning District Maps; and

WHEREAS, the Price County Board of Supervisors must then act upon the recommendation of the Zoning Committee, either approving or disapproving or returning the petition with changes recommended by the Price County Board of Supervisors, and WHEREAS, the Zoning Committee has held a public hearing and hereby recommends that the Price County Board of Supervisors ratify the amendment attached; NOW THEREFORE BE IT RESOLVED, that the Price County Board of Supervisors approve the amendments to the Price County Zoning Ordinance Section 17.0 Conditional Uses.  The revisions pertain to the following; Section 17.2 Basis of Approval, Section 17.3 (A) Application, Section 17.3 (D) Hearing, Section 17.3 (E) Town Recommendation, Section 17.3 (F) Determination, Section 17.3 (G) Mapping and Recording, Section 17.3 (H) Termination. Establish Price County Policy that All County Buildings and Enclosed Work Spaces are Smoke Free

WHEREAS, the Price County Board of Supervisors adopted Resolution #5212 Clean Indoor Air Law on February 16th, 1988 and made the Courthouse and Normal Buildings Smoke Free and on February 20th, 1990 adopted Resolution # 5320 which amended Resolution #5212 to include all County owned buildings in the requirement to be smoke free, and WHEREAS, The State of Wisconsin, during the 2009-10 Legislative Session, enacted 2009 Wisconsin Act 12 and Act 276 which established a smoking ban for any enclosed space, with only a few exceptions, and WHEREAS, 2009 Wisconsin Act 12 and Act 276 establishes clear requirements for designating “Persons in Charge” of buildings and penalties not just for the violators of the smoking ban law but also for the “Person in Charge” of the building who allow violations of the smoking ban law, and WHEREAS, the Human Resources Coordinator updated the Personnel Committee on the changes in the Wisconsin Law and the new requirements of employers to ensure a Smoke Free enclosed work space, and WHEREAS, The Personnel Committee is now recommending the rescinding of Resolutions #5212 and #5320 and replacing them with the Resolution to Establish Price County Policy that All County Buildings and Enclosed Work Spaces, as defined by 2009 Wisconsin Act 12 and Act 276, to be Smoke Free, and that this policy shall require that all entrances to buildings and enclosed work spaces be clearly posted as Smoke Free and that “Persons in Charge” be designated for County buildings and enclosed work spaces, and FUTHERMORE, require the Price County Human Resources Coordinator to update the Price County Personnel Policy and Procedures Manual Policy #350.0 Smoking to be in compliance with 2009 Wisconsin Act 12 and Act 276 County Policy, and NOW THEREFORE BE IT RESOLVED, by the Price County Board of Supervisors duly assembled this the 17th day of August, 2010, that Resolutions #5212 and #5320 be rescinded and be replaced with the Price County Policy that All County Buildings and Enclosed Work Spaces be Smoke Free. Approve Amendment to Policy #350.0 of the Price County Personnel Policy and Procedure Manual

WHEREAS, the Price County Board of Supervisors adopted an updated Personnel Policy and Procedures manual on February 21st, 2006 and, WHEREAS, The Personnel Committee has been charged by the Price County Board of Supervisors with the responsibility of developing, maintaining and enforcing policies and guidelines for employees and has also been charged with the responsibility of periodically reviewing said policies and procedures and, WHEREAS, The Price County Board has approved the Price County Policy for Smoke Free Buildings and Enclosed Work Spaces, and WHEREAS, this policy required the Human Resources Coordinator to update the Price County Policy and Procedures Manual to include the changes in Wisconsin State law and Price County Policy, and WHEREAS, the Personnel Committee has reviewed the updated Policy #350.0 of the Price County Personnel Policy and Procedures Manual and approves the changes, NOW THEREFORE BE IT RESOLVED, by the Price County Board of Supervisors duly assembled this the 17th day of August, 2010, that the Amendment to Personnel Policy #350.0 be approved and added to the Price County Personnel Policy and Procedures Manual, to be effective immediately. Approve Amendment to Policy #170.0 of the Price County Personnel Policy and Procedure Manual

WHEREAS, the Price County Board of Supervisors adopted an updated Personnel Policy and Procedures manual on February 21st, 2006 and, WHEREAS, The Personnel Committee has been charged by the Price County Board of Supervisors with the responsibility of developing, maintaining and enforcing policies and guidelines for employees and has also been charged with the responsibility of periodically reviewing said policies and procedures and, WHEREAS, Since the start of the direct deposit program in September of 2004, all new hires were required to receive their paycheck by direct deposit and more and more employees hired prior to September 2004 are participating in the program with very few Non-Represented and Casual employees still receiving paychecks, and WHEREAS, the Human Resources Coordinator is now recommending that all Non-Represented and casual employees be required to participate in the Direct Deposit Program and that Policy #170.0 of the Price County Personnel Policy and Procedures Manual be amended to reflect this change in the Direct Deposit Program, and WHEREAS, the Personnel Committee has reviewed this recommendation to amend Policy #170.0 of the Price County Personnel Policy and Procedures Manual and has determined that the changes to the policy will create more efficiency and cost savings for the County, NOW THEREFORE BE IT RESOLVED, by the Price County Board of Supervisors duly assembled this the 17th day of August, 2010, that the amendment to Personnel Policy #170.0 be approved and added to the Price County Personnel Policy and Procedures Manual to be effective with the first payday in September 2010. Secure Rural Schools and Community Self-Determination Act Payment Election for 2010 and Subsequent Years

Whereas, in 2008 per Resolution 83-08, Price County elected to receive a portion of the State payment under the Secure Rural Schools  and Community Self-Determination Act (SRS) as reauthorized per H.R. 1424 on October 3,2008, and Whereas, as part of the election to receive these payments, Price County elected to have 15% of such payment allocated as follows: 10% to Title II activities and 5% to Title III activities, and Whereas, per this election, Price County has received $14,297 for the 2008 payment and $12,937 for the 2009 payment of Title III funds to be used according to the provisions contained in the SRS and remains unspent, and Whereas, it has become evident that it will be difficult for Price County to effectively utilize the Title III funds for projects permitted by the SRS, and Whereas, any unspent Title III funds as of 9/30/2012 must be returned to the United States Treasury, and Whereas, a Resource Advisory Committee has now been established under Title II to recommend projects for implementation with Title II funding and will accept project recommendations from Price County, Price County municipalities and other persons, Now Therefore Be It Resolved, that the Price County allocation for 2010 and the remainder of the duration of the SRS be changed to the following amounts:  15% to Title II and 0% to Title III.
