Price County Zoning Committee Meeting Minutes of October 21, 2008Price County Courthouse—Room 107
The meeting was called to order at 8:02 a.m. by Chairperson Jim Robb. Members present were Richard Schneider, John Vlach, Richard Kelnhofer, Jim Robb and Bob Rogalla. Staff present included Zoning Administrator, Kevin Krause. Others included: Jackie Severt, Russ Severt, Tom Kiesgen, Rosemary Plant, Tracy Ellis (Price Co. Health Dept.), Joe Durand, Barb Richter, and George Tresnak.
Motion by Kelnhofer/Schneider to approve minutes of the October 9, 2008 meeting. All ayes. Motion carried.
Motion by Kelnhofer/Schneider to approve the Conditional Use Permit filed by Barbara J. Richter of Durand Companies for the purpose of operating a collection station for recycling on property located within part of the N1/2 of the SE1/4, Section 36, Township 39 North, Range 1 West, Town of Fifield (N12281 State Road 13) with the conditions as follows:
1. The property shall not be used as a transfer station wherein garbage is transferred from smaller containers to larger containers for transfer to a waste disposal facility. The maximum volume of garbage (as defined in Chapter 289 Wis. Stats) on the property shall be limited to 45 yards which may be part of a compactor system. For the purpose of this permit, tires, recyclables, and construction debris will not count against this limit since they are not considered garbage.
2. Collection and transfer of materials at this facility shall be limited to recyclable metals that are not considered hazardous, cardboard, paper, plastic, glass, and construction debris. Such materials shall be housed so as to not pose a threat to public health or safety.
3. Any floor drain within the existing commercial building or in a newly constructed building or addition shall be directed to an approved tank for proper disposal.
4. The approval of this Conditional Use Permit is subject to all applicable DNR administrative rules being adhered to.
5. The Zoning Department and Health Department reserve the right to inspect the property during normal business hours without prior notice.
6. Hours of operation, wherein the business is open to the public, shall be limited to 8:00 a.m. to 4:30 p.m. Monday through Friday and 9:00 a.m. to 12:00 p.m. on Saturday. The facility shall not be open to the public on the holidays as follows: New Years Day, Easter, Memorial Day, 4th of July, Labor Day, Thanksgiving, Christmas Eve, and Christmas Day.
7. There shall be no burning of solid waste materials on the premises.
8. The owners agree to maintain Business Liability Insurance in the amount of $1,000,000. This dollar value shall be reviewed annually at the January Zoning Committee meeting. Price County reserves the right to request a higher limit or to request any necessary changes to the liability insurance. Price County and the Town of Fifield will be named on the policy as additional insureds. A copy of the applicable insurance contract with annual renewals shall be submitted to the Price County Zoning Department.
9. A fence will not be required as part of this Conditional Use Permit along the north property line, however, there shall be nothing stored between the northern property line and the northern exterior wall of the existing commercial building or any addition onto the existing commercial structure or any newly constructed structure erected as part of the collection facility. A driveway is permissible in this area, but this portion of the property is to remain as a buffer area comprised of a maintained lawn or natural woodland and not a parking lot. The storage of any garbage, refuse or equipment, even on a temporary basis, shall be excluded from this portion of the property.
10. Access to the existing commercial building or any addition onto the existing commercial structure or any newly constructed structure erected as part of the collection facility shall not be located on the north side of such structure. A 3-sided structure shall have the opening or access only on the south face of the structure.
