Price County Zoning Committee Meeting Minutes of February 12, 2009Price County Normal Building—UWEX Conference Rooms A & B
The meeting was called to order at 9:00 a.m. by Chairman Jim Robb. Members present were Richard Schneider, John Vlach, Richard Kelnhofer, and Bob Rogalla. Staff present included Zoning Administrator, Kevin Krause. Others in attendance included Tom Strobl, Ginny Strobl, Russell Severt, George Tresnak, Ed Belan, Tom Kiesgen, Jerid Baranczyk, Julie Wolski, Kevin Jenkins, Steve Krings, Jim Rutherford, Julie Fischer, Kathy Kascewicz and Robert Kopisch.
Motion by Rogalla / Kelnhofer to approve the minutes of the January 8, 2008 meeting. Motion carried.
Motion by Kelnhofer / Vlach to approve the expenditures for January. Motion carried.
The 2008 finance report (with annotated notes) and the January 2009 finance report were presented to the Zoning Committee for review.
Public Hearings:
Motion by Kelnhofer / Schneider to approve with conditions the Conditional Use Permit filed by American Asphalt of Wisconsin, Mosinee, WI to operate a temporary asphalt plant on property owned by Bill Smasal, described as S ½ of the SW ¼ SE ¼, Section 25, Township 39 North, Range 1 West, Town of Fifield. Motion carried. Conditions of approval are as follows: 1.) The CUP will expire 12/31/2012. 2.) Hours of operation for the asphalt plant shall be Mon-Fri 6:00 a.m. to 6:00 p.m. and Sat 6:00 a.m. to 3:00 p.m.
Motion by Rogalla / Vlach to forward to the Price County Board of Supervisors for consideration the petition for zoning amendment filed by Stephen Krings to rezone property from Agricultural District (A-1) to Recreational Residential District (RR-1) for the purpose of a short-term/weekly rental on property described as Lot 7 of the Crowley Shores Subdivision, Section 14, Township 39 North, Range 2 West, Town of Lake (N13597 Crowley Road) with a recommendation of approval. Motion carried.
Motion by Kelnhofer / Schneider to approve with conditions the Conditional Use Permit filed by Stephen Krings for a short-term/weekly rental on property described as Lot 7 of the Crowley Shores Subdivision, Section 14, Township 39 North, Range 2 West, Town of Lake (N13597 Crowley Road). Motion carried. Conditions of approval are as follows: 1.) The CUP is subject to the rezone petition being approved by the Price County Board of Supervisors.
Motion by Rogalla / Vlach to forward to the Price County Board of Supervisors for consideration the proposed amendment (wind energy) to section 10.8 of the Price County Zoning Ordinance 4-79 with a recommendation of approval. Motion carried.
Motion by Vlach / Kelnhofer to forward to the Price County Board of Supervisors for consideration the proposed amendments (addition of permitted uses, accessory uses, and conditional uses to the RR-1, RF-1, RF-C, CI-C, CI-I, A-1, and RB-R Zoning Districts) to section 7.2 of the Price County Zoning Ordinance 4-79 with a recommendation of approval. Motion carried.
LAND DIVISIONS
Motion by Kelnhofer / Vlach to postpone the land division filed by Richard Biller to create two lots located in the SE ¼ SW ¼, Section 1, Township 39 North, Range 1 West, Town of Fifield. Motion carried.
Motion by Schneider / Vlach to approve the Land division filed by Patrick Beil on behalf of Susan Gunderson to create 4 lots located in the NW ¼ of the NW ¼, the SW ¼ of the NW ¼, SE ¼ of the NW ¼, Government Lot 3 and also part of Lot 2 of CSM #1217, Section 11, Township 39 North, Range 3 East, Town of Fifield. Motion carried.
MISCELANEOUS ITEMS
1. Correspondence/Public Comment. · Kathy Kascewicz read a letter. · Kevin presented to the committee a couple of letters not in the monthly report. · Tom Kiesgen read a letter. 2. Motion by Rogalla to deny the Special Exception filed by George Moravcik. Motion failed due to a lack of a second. Motion by Vlach / Schneider to conduct a public hearing at the March meeting for the special exception request amended by Mr. Moravcik. Motion carried. 3. Kevin reported that Corporation Counsel would be filing paperwork with the Clerk of Courts by the end of the week to seek injunctive relief against Joe France. 4. Motion by Rogalla / Kelnhofer to postpone items 4, 5, and 6 on the agenda to March. Motion carried. 5. See item 4. 6. See item 4. 7. Motion by Kelnhofer / Schneider directing Kevin to draft an ordinance amendment regarding changes as discussed for the Board of Adjustment. Motion carried. 8. Motion by Schneider / Rogalla to not renew a contract with Mark and Julie Fischer to list county owned parcels through Century 21 Hilgart Realty. Motion carried. 9. Kevin gave a brief review of the monthly reports and the issue with the 911 emergency numbers. 10. The Zoning Committee along with County Board Chairman Bob Kopisch discussed the open records request they all recently received. It was agreed that there has been no correspondence between individual members regarding the subject in the request. All correspondence was with the Zoning Department and those records have been made available for inspection to the individuals who submitted the open records request. 11. The next regularly scheduled Zoning Meeting will be held March 12, 2009 at 9:00 a.m. 12. Motion by Kelnhofer / Vlach to adjourn at 10:34 a.m. Motion carried.
