Price County Zoning Committee Meeting Minutes of February 14, 2008

The meeting was called to order at 9:00 a.m. by Chairperson Leona DeRemer.  Members present were Leona DeRemer, Richard Kelnhofer, Elvis Presley, Bob Rogalla and Jim Robb. Staffs present included: Zoning Administrator, Kevin Krause and Assistant Zoning Administrator, Amanda McMeekin.  Others included: Steve Single, Ginny Strobl, Thomas Strobl, Tim Savino, Julie Wolski, Polly Lallemont, Dennis Schroeder, Bill Marion, Arlene Marion, Cari Jeske, Mark Wagner, Tom Griffith, Peter VanGalder, and Mike Case.

 

Motion by Presley / Robb to approve minutes of the January 10, 2008 meeting.  All ayes.  Motion carried.

 

Motion by Presley / Kelnhofer to approve expenditures for 2007 Period 13. All ayes.  Motion carried. 

 

Motion by Presley / Kelnhofer to approve expenditures for January 2008. All ayes.  Motion carried. 

 

Motion by Rogalla / Presley to approve the Finance Report for 2007 and January 2008. All ayes.  Motion carried.

Public Hearings:

 

 

Motion by Rogalla / Presley to forward to the Price County Board of Supervisors for their consideration of the Petition for Zoning Amendment filed by Stephen Single to rezone property from Recreational Residential District (RR-1) to Commercial District (CI-C) for the purpose of operating rental cabins on property located within part of Government Lot 2, Section 13, Township 37N, Range 1W, Town of Elk (N8781 Golf Course Road) with a recommendation of approvalAll ayes.  Motion carried.     

 

Motion by Robb / Kelnhofer to approve the Conditional Use Permit filed by Stephan and Susan Flagstad for the purpose of building a gard gazebo on property located within part the NW1/4 NW1/4, Section 25, Township 40N, Range 3E, Town of Fifield (N15155 Thorofare Road).  All ayes.  Motion carried.      

              

Motion by Presley / Robb to approve the Conditional Use Permit filed by Stephan and Susan Flagstad for the purpose of building a waterfront storage structure on property located within part the NW1/4 NW1/4, Section 25, Township 40N, Range 3E, Town of Fifield (N15155 Thorofare Road).All ayes.  Motion carried.                      

Motion by Robb / Kelnhofer to forward to the Price County Board of Supervisors for their consideration of the Petition for Zoning Amendment filed by Tim Savino to rezone property from Agricultural District (A-1) to Recreational Residential District (RR-1) for the purpose of private residences.  The property includes all units and common elements of the South Fork 1st Addition Condominiums located within part of Section 24, Township 39N, Range 1W, Town of Fifield with a recommendation of approvalAll ayes.  Motion carried.     

 

Motion by Robb / Presley to approve  the Conditional Use Permit filed by Tim Savino for the purpose of a short-term rental of a home located on unit 14 of the South Fork  1st addition Condominiums located within part of Section 24, Township 39N, Range 1W, Town of Fifield(W7338 Flambeau River Road).  All ayes.  Motion carried.        

 

Motion by Presley / Robb to forward to the Price County Board of Supervisors for their consideration of the Petition for Zoning Amendment filed by Peter D. VanGalder to rezone property from Agricultural District (A-1) to Commercial District (CI-C) and Recreational Business-Residential District (RB-R) for the purpose of operating rental cabins, a campground and continuing to operate a bar and grill on property located within part of the SE1/4 NE1/4, Section 13, Township 37N, Range 2W, Town of Elk (W9701 County Road W) with a recommendation of approvalAll ayes.  Motion carried.     

 

Motion by Kelnhofer / Presley to forward to the Price County Board of Supervisors for their consideration of the Petition for Zoning Amendment filed by Marques and Lisa Rogers to rezone property from Agricultural District (A-1) to Recreational Residential District (RR-1) for the purpose of the short-term rental of a home located within part of Government Lot 1, Section 20, Township 38N, Range 2W, Town of Flambeau (N10791 Berg Road) with a recommendation of approvalAll ayes.  Motion carried.     

 

Motion by Rogalla / Robb to deny the Conditional Use Permit filed by Marques and Lisa Rogers for the purpose of the short-term rental of a home located within part of Government Lot 1, Section 20, Township 38N, Range 2W, Town of Flambeau (N10791 Berg Road).  Roll call:  Ayes – Robb, Rogalla, DeRemer, Nays – Kelnhofer, Presley.  Motion carried.        

 

Motion by Rogalla / Presley to approve the Special Exception Permit filed by David Heid for the purpose of building a residence and outbuilding with the following reduced setbacks; front yard setback of 20’ from the right of way, 5’ from the side yard lot lines, and 15’ from the rear yard lot line located within the Hintz Addition Lot 12 Block 6, Section 6, Township 39N, Range 1E, Town of Fifield, subject to Town approval.  Approval is subject to the Town of Fifield submitting a written document stating that they do not appose to the special exception permit.  All ayes.  Motion carried.  (Presley originally made a motion to table the permit, but he rescinded his motion)        

 

 

Land Divisions/CSM Review/Plat Review

 

Motion by Rogalla / Presley to table the Land division filed by Albert Simpson on behalf of Bernard Kubisiak to create 3 lots located in the SW ¼ NE ¼, Section 13, Township 37 North, Range 2 West, Town of Elk.  All ayes.  Motion carried.

 

Motion by Presley / Kelnhofer to approve the Land division filed by Albert Simpson on behalf of Russ Graceffa to create 1 lot located in the SW ¼ NE ¼, Section 36, Township 40 North, Range 1 East, Town of Eisenstein.  All ayes.  Motion carried.

 

Motion by Presley / Robb to table the Land division filed by Charley Brinkmeier on behalf of Dwight Freymiller to create 1 lot located in Government lot 17, Section 30, Township 35 North, Range 1 East, Town of Ogema.  All ayes.  Motion carried.

 

Miscellaneous Items

 

1.         Correspondence/Public Comment.

2.         Motion by Presley / Kelnhofer to forward to the Price County Board of Supervisors for their consideration of the proposed amendment to the following county ordinance; Price County Floodplain Ordinance, as presented at the public hearing conducted Jan. 10, 2008, with a recommendation of approvalAyes – Presley, Kelnhofer, Robb, Nay – Rogalla.  Motion carried.  

 

3.         Discussion and/or action on enforcement activity.

o        Kevin Krause discussed the Otruba, Baars, & Thompson cases with the Committee.

 

4.         Discussion on the implementation of the wireless 911 system for Price County.

o        Kevin Krause discussed that the 911# system will be turned over to the Law Enforcement Committee.

 

5.         Motion by Presley / Rogalla to forward to the Price County Board of Supervisors for their consideration the ordinance revisions to the Town of Georgetown Zoning Ordinance with a recommendation of approvalAll ayes.  Motion carried.

 

6.         Motion by Presley / Robb to forward to the Price County Board of Supervisors for their consideration the ordinance revisions to the Town of Worcester Zoning Ordinance with a recommendation of approvalAll ayes.  Motion carried.

 

7.         Motion by Presley / Kelnhofer to approve the refund of the CUP fee for Fred and Shelly Hilgart.  All ayes.  Motion carried.

 

8.         Motion by Presley / Kelnhofer to approve refund of the after-the-fact land use fee for James Tomic.  All ayes.  Motion carried.

 

9.         Motion by Presley / Rogalla to adopt the codified Price County Zoning Ordinances as presented.  All ayes.  Motion carried.

 

10.     Staff Report.
