Price County Zoning Committee Meeting Minutes of July 10, 2008

Price County Normal Building—UWEX Conference Rooms A & B

 

The meeting was called to order at 9:01 a.m. by Chairperson Jim Robb.  Members present were Richard Schneider, John Vlach, Richard Kelnhofer, Bob Rogalla and Jim Robb. Staffs present included: Zoning Administrator, Kevin Krause and Assistant Zoning Administrator, Amanda McMeekin.  Others included: Jody DeLasky, Gerry Torgeson, Rich Golab, Jay Silvernail, Wendy Rodewald, Jill Zohimsky, Steve Zohimsky, Jim Gabrielsen, Joe Moulis, Donna Moulis, Karl Pippenger, Lucile Erickson, Bob Philippon, Jeanine Philippon, Jean Bolton, and Stanley Mindock.

 

Motion by Rogalla / Vlach to approve the minutes of the June 12, 2008 meeting.  All ayes.  Motion carried.

 

Motion by Rogalla / Kelnhofer to approve the expenditures and Finance Report for June 2008. All ayes.  Motion carried. 

 

 

 

Discussion and/or Action Items

 

Public Hearings:

 

 

Motion by Rogalla / Schneider to approve the Special Exception permit filed by Kevin W. Shibilski for the purpose of building a garage with the following reduced setbacks; 8’ setback from the R.O.W of County Road W and a 5’ setback from the R.O.W. of S. Long Lake Drive on property located within part of Government lots 5 and 6, Section 13, Township 37N, Range 1W, Town of Elk (W7396 S. Long Lake Road).   All ayes.  Motion carried.   

 

Motion by Schneider / Rogalla to forward to the Price County Board of Supervisors for their consideration of the Petition for Zoning Amendment filed by Kevin Shibilski to rezone property owned by Fred and Deborah Heldt from Recreational Residential District (RR-1) to Recreational Business-Residential District (RB-R) for the purpose of continuing to operate the property as a resort (resort is currently operating under a conditional use permit).  Property is located within part of Government Lots 5 and 6, Section 13, Township 37N, Range 1W, Town of Elk (W7396 S. Long Lake Road) with a recommendation of approval.  All ayes.  Motion carried.     

 

Motion by Vlach / Kelnhofer to approve the Conditional Use Permit filed by Reclaimed Rustic Woodworks, Inc. for the purpose of operating a barnwood cabinet shop on property located within part the SW1/4 NW1/4, NW1/4 SW1/4, SW1/4 SW1/4, Section 15, Township 38N, Range 1W, NE1/4 SE1/4, SW1/4 SE1/4, SE1/4 SE1/4 Section 16, Township 38N, Range 1W, and NE1/4 NE1/4, NW1/4 NE1/4, Section 21, Township 38N, Range 1W, Town of Flambeau (N11067 County Road F).  All ayes.  Motion carried. 

   

Motion by Rogalla / Kelnhofer to table until the August 14th Zoning Meeting for further discussion the proposed amendment to the following county ordinance; Price County ­­­­­­­­­­­­­­­­­­­­Ordinance 4-97 Regulating the Height of Structures and Trees in the Vicinity of the Price County Airport.  A public hearing is to be conducted again at the August 14th meeting with only a class III notice being published as notice for the hearing.  All ayes.  Motion carried.     

 

Motion by Rogalla / Kelnhofer to approve the Conditional Use Permit filed by Marques Rogers for the purpose of a short-term rental of a home located within part of SE1/4 NW1/4, Section 12, Township 37N, Range 2W, Town of Elk (N9132 Island Road), with the condition that the property be managed by a local rental company. All ayes.  Motion carried.     

 

 

LAND DIVISIONS

 

There are no land divisions for July.

 

 

MISCELANEOUS ITEMS

 

1.         Correspondence/Public Comment.

o        All correspondence and public comment is in the Monthly Report.

o        Richard Kelnhofer added that he would like to talk to the Executive/Finance Committee regarding collecting county sales tax from short-term rentals.

 

2.         Discussion of enforcement action against individuals as follows:

·         Joe France

o        Waiting for Leanna Arnoldi (Asst. Corp. Counsel) to send a letter to Joe France regarding his buffer installation.  Kevin is to send Leanna an email to expedite the process.

 

·         Corey Brockman

o        Corey was delivered a citation due to his lack of action to obtain a permit on an illegal septic system that was installed on his property.

 

·         Lyle Baars

o        Clean up is to begin on July 14th run through the 15th.

 

·         Charles Rolli

o        Motion by Vlach / Schneider directing Kevin Krause to send a letter to Bruce Marshall stating that the Committee is opposed to what he did.  A copy will be sent to the County Board Chair.  All ayes.  Motion carried.     

 

3.         Resolution from Florence County regarding the amendment to the Federal Water Pollution Control Act.

o        Motion by Vlach / Rogalla to postpone until August meeting. All ayes.  Motion carried.     

 

4.         Proposed revisions to the Price County Shoreland Ordinance regarding the regulation of impervious surfaces and structures exempt under chapter 59.692(1v) Wis. Stats. (Gard Gazebo).

o        Motion by Kelnhofer / Schneider to send the revisions to public hearing with each item as a separate revision with a separate public hearing. All ayes.  Motion carried.     

 

 

 

5.         Work schedule for Zoning employees and department office hours.

·         Kevin gave a report that the employees of the department would be flexing schedules until November to each work a four day work week, but the office would remain open for five days a week with longer office hours.

 

6.         Reclassification of the Zoning Program Assistant position.

o        Bob Rogalla made a motion, but withdrew his motion.  No action was taken.

 

7.         Staff Report.

·         Kevin gave a brief report.

 

8.         The next meeting is to be held on August 14, 2008 at 9:00 a.m.
