Price County Zoning Committee Meeting Minutes of August 13, 2009

Price County Normal Building—UWEX Conference Rooms A & B

 

The meeting was called to order at 9:03 a.m. by Chairman Jim Robb.  Members present were Richard Schneider, Richard Kelnhofer, Bob Rogalla and John Vlach. Staff present included Zoning Administrator, Kevin Krause.  Others in attendance were Russell Severt, Tom Kiesgen, Gerald Hetzel, John Buchta, Gabriela Buchta, Tom Kane, and Vern Moore.

 

Motion by Kelnhofer / Schneider   to approve the minutes of the July 9, 2009 meeting.  Motion carried.

 

Motion by Kelnhofer / Vlach to approve the expenditures for July 2009.  Motion carried.

 

The 2009 year-to-day finance report was presented to the Zoning Committee for review. 

 

Public Hearings:

 

Special Exception permit filed by Thomas and Patricia Kane for the purpose of building a garage 42’ from the centerline of Meadow Lane on property located within part of the Butternut-Schnurs Lakes Assessors Plat #1 Lot 22, Section 8, Township 40N, Range 1W, Town of Lake (N16459 Meadow Lane).  Motion by Kelnhofer / Schneider to approve.  Motion carried.

 

Conditional Use Permit filed by Charles and Patricia Huff for the purpose of the weekly rental of a home on property located within Sugar Bush Estates Lot 8, Section 24, Township 40N, Range 1E, Town of Eisenstein (W4947 E Sugarbush Lane).  Motion by Vlach / Rogalla to postpone until the September meeting.  Motion carried.

 

Public hearing on the proposed amendment to the following county ordinance; Price County Land Sales Ordinance 89-10, Section 3.4 regarding procedures under which the Committee is allowed to sell parcels of land.  Motion by Vlach / Schneider to forward to the County Board for consideration with a recommendation of approval.  Motion carried.

 

 

 

LAND DIVISIONS

 

There were no land division requests.

 

MISCELANEOUS ITEMS

 

1.         Correspondence/Public Comment.  There was no public comment.

2.         Changes/corrections to the conditions of the Lee Conditional Use Permit approved July 9, 2009.  Motion by Rogalla / Kelnhofer to amend the original conditions of the Conditional Use Permit to increase the number of renters from four to six.  Motion carried.

3.         2010 Zoning Budget.  Motion by Rogalla / Vlach to forward the amended budget to the Executive / Finance Committee for consideration.  Motion carried.

4.         Staff Report.  Kevin briefly explained the monthly report and the current workload.

5.         Adjourn to closed session as provided by Chapter 19.85(g) Wis. Stats. for the purpose of conferring with legal counsel who is rendering oral or written advice concerning strategy to be adopted with respect to litigation in which the Zoning Committee is or is likely to become involved regarding the Richter/Durand Conditional Use Permit and the Joe France enforcement case.  Motion by Vlach / Kelnhofer to adjourn to closed session at 9:43 a.m.

6.         Return to open session and take action as necessary on closed session item.  Motion by Vlach / Rogalla to return to open session at 10:30 a.m.

Motion by Vlach / Kelnhofer to defer taking any action regarding the Durand/Richter Conditional Use Permit until Attorney Bruce Marshall is able to attend a zoning meeting and confer with committee.  Motion carried.

Motion by Vlach / Kelnhofer to arrange through legal counsel a site visit of the Joe France property to be conducted the day of the September zoning meeting.  Motion carried. 

7.         Town of Flambeau request for a Conditional Use Permit to operate a gravel pit.  Motion by Kelnhofer / Rogalla to conduct a public hearing at the September zoning meeting for the Conditional Use Permit to operate a gravel pit.

8.         Established date and time of next meeting.  September 10, 2009 @ 9:00 a.m.

9.         Adjourn.  Motion by Kelnhofer / Vlach to adjourn at 10:49 a.m.  Motion carried.
