Price County Zoning Committee Meeting Minutes of September 10, 2009

Price County Normal Building—UWEX Conference Rooms A & B

 

The meeting was called to order at the Polish Palace/Sunset Haven Resort at 8:00 a.m. by Chairman Jim Robb for the purpose of discussing the shoreland buffer as it relates to enforcement action against the owner Joe France.  Members present were Richard Schneider, Richard Kelnhofer, Bob Rogalla and John Vlach. Staff present included Zoning Administrator, Kevin Krause and Assistant Zoning Administrator Amanda McMeekin.  Chairman Robb recessed the meeting at 8:46 a.m.  The meeting reconvened at 9:10 a.m. in the Price County Normal Building – UWEX Conference Rooms A & B.

 

Motion by Kelnhofer / Schneider to approve the minutes of the August 13, 2009  meeting.  Motion carried.

 

Motion by Vlach / Kelnhofer to approve the expenditures for August 2009.  Motion carried.

 

The 2009 year-to-day finance report was presented to the Zoning Committee for review. 

 

Public Hearings:

 

Special Exception permit filed by John Gutwein for the purpose of building a garage 39’ from the centerline of Brahmstadt Road on property located within part of Government Lot 3, Section 35, Township 40N, Range 3E, Town of Fifield (N14744 Brahmstadt Road).  Motion by Rogalla / Kelnhofer to approve with conditions.  Motion carried.  Conditions of approval:  The building shall be no more than 40’ wide (as measured from west to east).

 

Special Exception Permit filed by Andrew Mlodzik for the purpose of placing an RV 45’ from the centerline of Divine Rapids Road on property located within part the NW1/4 NW1/4, Section 32, Township 40N, Range 1E, Town of Fifield (N14926 Divine Rapids Road).  Motion by Kelnhofer / Rogalla to approve with conditions.  Motion carried.  Conditions of approval:  The driveway shall be moved to be 3’ from the property line.

 

Petition for zoning amendment filed by Larry Meidam to rezone property from Agricultural District (A-1) to Residential Forestry District (RF-1) as required by a bank for a new home on property described as the NE1/4 SE1/4, Section 8, Township 34 North, Range 3 East, Town of Spirit (N1889 S. West Road).  Motion by Vlach / Kelnhofer to send to the full county board with a recommendation of approval.  Motion carried.  

 

Petition for zoning amendment filed by Todd’s Redi Mix Concrete, LLC to rezone property from Agricultural District (A-1) to Commercial-Industrial District (CI-1) for the purpose of a ready mix plant operation in an existing gravel pit on property described as part of Government Lot 5, Section 31, Township 39 North, Range 1 East, Town of Fifield (N12502 State Road 13).  Motion by Schneider / Kelnhofer to send to the full county board with a recommendation of approval.  Motion carried.    

 

Conditional Use Permit filed by the Town of Flambeau for the purpose of operating a gravel pit on property owned by Price County located within the NE1/4, Section 14, Township 38N, Range 1W, Town of Flambeau.  No action taken since the Town of Flambeau withdrew their request.

 

LAND DIVISIONS

 

There were no land division requests.

 

MISCELANEOUS ITEMS

 

1.         Correspondence/Public Comment.  Ginny Strobl made a comment regarding the records request form being posted on the Zoning website.

2.         Charles and Patricia Huff CUP.  Motion by Schneider / Kelnhofer to approve with conditions.  Motion carried.  Conditions of approval:  Conditions that are listed on Mark Wagner’s Century 21 Hilgart Realty contract for short-term rental must be adhered to.

3.         Revision to the nonmetallic mining ordinance.  No action taken.

4.         Ordinance revision regarding complaints/inspections of conditional use permits.  A proposed change to the Zoning Ordinance to address the matter will be brought back to the Zoning Committee for consideration at the October meeting.

5.         Revision to the Zoning Department Policy and Procedure manual regarding open records requests.  Motion by Kelnhofer / Schneider to adopt revisions as discussed.  Motion carried.

6.         Staff Report.  Kevin gave a brief report of the activity in the last month.

7.         Adjourn to closed session as provided by Chapter 19.85(g) Wis. Stats. for the purpose of conferring with legal counsel who is rendering oral or written advice concerning strategy to be adopted with respect to litigation in which the Zoning Committee is or is likely to become involved regarding the Joe France enforcement case and the  Richter/Durand Conditional Use Permit.  Motion by Kelnhofer / Vlach to adjourn to closed session at 11:14 a.m.

         No action taken in open session regarding the closed session items.
